I. Introduction

The following Terms of Service supplement (are in addition to) the TinkerHost General Terms of Service located at https://tinkerhost.net/legal/terms.

This document outlines the additional terms you agree to when accessing the TinkerMail platform. If you do not agree to the terms in this document in their entirety, do not access or use the TinkerMail platform in any way.

II. Definitions

The following Terms apply when you view, access, or utilize our website or services located under the tinkerhost.net domain (Including all subdomains), hereby referred to as the “Service”. Our website and its contents will hereby be referred to as the “Site”. TinkerHost shall hereby be referred to as “We”, “Us”, or the “Company”.

Agreement to the following terms shall be further restricted to users who explicitly agree to these terms, or complete any of the following actions: register a TinkerMail plan; Access any URL containing /mail/; Accessing, Modifying, or Viewing a TinkerMail management page, including statistics and webmail dashboards; Generating or using SMTP credentials; Linking a TinkerMail account to a TinkerHost Pro account. These actions define the usage of the “TinkerMail” platform, and will henceforth be known as such.

III. Privacy Policy

By creating a Service account and accessing the TinkerMail Platform, you agree to our privacy policy located at https://tinkerhost.net/legal/privacy-policy, Stripe's Privacy Policy located at https://stripe.com/privacy, and the AWS Privacy Policy located at https://aws.amazon.com/privacy/.

IV. About The Service

The TinkerMail Platform allows you (the “User”) to access additional features and services provided by the Company. Creating a TinkerMail Platform account does not guarantee access to any Company Service.

The TinkerMail Platform allows Users to complete one time payment charges, recurring payment charges (Multiple charges spanning a period of time), in return for SMTP sending and mail forwarding services. The TinkerMail Platform partners with Stripe for PII compliance and card processing, by creating a TinkerHost Payments account, you agree to Stripe's Privacy Policy (Located at https://stripe.com/privacy) and Terms of Service (Located at https://stripe.com/legal/ssa). The TinkerMail Platform also partners with Amazon Web Services to deliver some platform services, this may affect your legal relationship with AWS, please contact AWS for additional information.

V. Registration and User Conduct

When creating a TinkerMail Platform account, you may be required to open a TinkerHost Payments account. The information connected to your TinkerHost Payments account will be used to create your TinkerMail Platform account, it is your responsibility to keep this information up-to-date and accurate. Your TinkerMail Platform account may be suspended and incoming and outgoing email messages associated with your account may be permanently lost if the information connected to your TinkerHost Payments account is invalid, incomplete, or out of date.

Your TinkerMail Platform account is private, and belongs only to you. Do not share your account with others, even if you trust them. Inform the Service immediately if you believe someone else has accessed your account. We recommend you configure two-factor authentication in your account settings, and use a strong hard-to-guess password. You are responsible for your account, TinkerHost is not liable in any way for actions taken on your account, including but not limited to fraudulent charges, unwanted mail sends, and invalid or incorrect data.

You must have a valid email address that can receive emails when you have a domain connected to a TinkeMail Platform account. Failure to routinely check and address notifications (Including but not limited to random email verification messages) may result in the suspension of your TinkerMail Platform account, and permanent loss of all TinkerMail Platform features. Be aware of scams, TinkerHost will never ask for your personal information over email. If you are not sure if an email originated from TinkerHost, do not disregard the message as it may be important. VI. Usage Restrictions

You agree to use your TinkerMail Platform account legally, and in good faith. TinkerMail account registrations should not be used to create, duplicate, share, distribute, or otherwise make available (Publicly or privately) illegal content, explicit adult content, streaming services of copyrighted content without explicit permission, downloads of cracked/pirated software and other related content. Additionally, you may not use the service for email spoofing, hoaxes, or other illegal or unwanted messages. The Service reserves the right to suspend and/or permanently remove any and all accounts in violation of the terms without warning nor refund.

You agree not to use the TinkerMail Platform to send large amounts (As determined by the Service, at their sole discretion, based on account activity) of unsolicited (Defined as messages to users not resulting from a direct action, including but not limited to Advertisements, Marketing, and other messages not resulting from a direct (Or directly implied) opt-in action). The service holds sole and complete discretion when determining if a message is unsolicited or otherwise in violation of these terms.

The Service uses an automated system to detect high or unusual amounts of outgoing messages marked as spam by recipients, or messages that bounce or are otherwise unable to be delivered. The Service may choose to block emails from outgoing messages across all TinkerMail accounts for reasons that may include but are not limited to excessive complaints or email bounces. Non-deliverability messages may be shown in the TinkerMail dashboard, but are not guaranteed. TinkerMail Platform accounts that are detected to have high or unusual amounts of bounces messages or those marked as spam may be temporarily suspended pending investigation.

Failure to abide by the terms in this document, or any other TinkerHost Terms of Service you have agreed to may result in the immediate and permanent suspension of your TinkerMail Platform account, and potentially your base Service account as well.

The Service may additionally suspend, permanently or temporarily, and with or without prior notice your TinkerMail Platform account for any reason. The Service is not obligated to share the suspension reason with you, and may allow temporary account access while an alternate provider is located at the Services sole discretion.

VII. Account Funds

The TinkerMail Platform allows payment for domains and related services via account funds. When completing a transaction using your Account Funds, you signify your agreement to the TinkerHost Payments Terms of Service.

VIII. Revoking Consent

To revoke your consent to these Terms, remove all TinkerMail accounts from the TinkerMail Platform, then send an email to tinkermail_revoketosconsent[@]tinkerhost.net from your account email address. You will still be legally bound to this document until you receive an email from TinkerHost explicitly stating you are no longer bound to this document.

Alternatively, you may delete your Service account at any time. Please refer to the base Terms of Service for additional information.
